What happens when you are caught by a red light camera?

The camera captures two photographs showing your vehicle crossing the stop line and entering the junction while the traffic light is red. The registered keeper receives a NIP (Notice of Intended Prosecution) within 14 days, along with a section 172 notice requiring them to identify the driver. The standard penalty is £100 and 3 points.

Step 1: Check the NIP timing

The NIP must be served within 14 days under s.1 Road Traffic Offenders Act 1988. If it arrived late, prosecution cannot proceed. This is the single strongest defence. Check the date on the NIP against the date of the alleged offence.

Step 2: Request the photographic evidence

Before deciding how to respond, request the camera photographs from the police. The evidence must clearly show your vehicle crossing the stop line while the light is red. If the images are unclear, if only one photograph was taken, or if the traffic light status cannot be determined, the evidence may be insufficient.

Step 3: Consider your defence grounds

  • NIP served late (s.1 RTOA 1988)
  • Camera malfunction or lack of calibration evidence
  • Amber phase too short (minimum 3 seconds urban)
  • Emergency vehicle avoidance (defence of necessity)
  • Traffic light obscured or not visible
  • You were not the driver
  • You stopped beyond the line but did not enter the junction

Step 4: Respond to the NIP

You must respond to the s.172 notice identifying the driver within 28 days — failing to do so is itself a criminal offence carrying 6 points. You can identify the driver and still challenge the red light allegation. If you wish to contest, you can request a court hearing instead of accepting the fixed penalty.
